1. Introduction

By submitting a question to and continuous accessing BloFin AI, you are agreeing to the following Terms of Use (“BloFin AI Terms”).

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING BLOFIN AI. The following BloFin AI Terms are intended to inform users of the limitations and usage guidelines of the artificial intelligence tool ("BloFin AI") provided within BloFin.com ((“BloFin”, “we”, “us”, “the Platform”). By using the Service defined herein, you have read, understood, and agree to be legally bound by these BloFin AI Terms, including any revisions as may be published by us at any time and from time to time.

You acknowledge that you have also read and understood any additional documents or terms referred to or incorporated into these BloFin AI Terms. If you do not understand and accept these BloFIn AI Terms in their entirety, you should cease to use the Service.

These Terms are supplemental to and shall be read together with the BloFin’s Terms of Use ("Terms of Use"). All terms and clauses contained in the Terms of Use (except to the extent expressly modified herein) are incorporated by reference and have the same force and effect as if set out in their entirety in these BloFin AI Terms.

In the event of any conflict or inconsistency between these BloFin AI Terms and the Terms of Use, these BloFin AI Terms shall prevail with respect to the Services contemplated hereunder, unless expressly stated otherwise. We may make changes to these BloFin AI Terms (or any terms or information incorporated by reference) at any time.

2. Services

2.1 BloFin AI is provided on an ‘as is’ and ‘when available’ basis. BloFin AI is designed to provide information relating to the products and/or services provided by BloFin within the Platform from time to time ("Services"). 

2.2 BloFin AI is subject to limited amount of uses per day. Kindly contact our customer support for more information. BloFin reserves the right to amend, change and modify the key benefits and features provided by BloFin AI without prior notice. 

2.3 BloFin reserves the rights to implement new versions and upgrades of BloFin AI including, but not limited to, changes that effect modifications to the design, features, operational method, technical specifications, systems and other functions, etc. of BloFin AI, at any time without prior notice. 

3. Disclaimers

3.1 BloFin AI uses generative AI to generate the Outputs. BloFin AI may, at times, provide information that is inaccurate or incomplete and may not reflect human expertise. Therefore, you must verify any information provided by BloFin AI before taking any action or making any decisions based on the information received. BloFin assumes no responsibility and does not guarantee the accuracy or completeness of the information provided. 

3.2 BloFin AI uses inputs, including but not limited to, text prompts, image, audio files, documents, data or other content provided by you or used at your direction and/or the metadata processed on and through the Platform ("Inputs") to generate outputs insights ("Outputs").

3.3 BloFin does not guarantee the accuracy or consistency of any Outputs generated by the BloFin AI. Given the nature of BloFin AI, use of the Services may in some situations result in incorrect Output that does not accurately reflect the action generated. You shall evaluate the accuracy by verifying the information of any Output and shall not rely on BloFin to do so. 

3.4 Neither BloFin nor any of our directors, employees, affiliated companies and representatives (i) make any representation or warranty that the Services is suitable, available or appropriate, for any user in any location; nor (ii) accept any liability regarding the information provided and cannot be held liable for any actions, losses, or damages resulting from the use of BloFin AI. 

3.5 BloFin AI is an artificial intelligence service and should be used at your own risk. We are not liable to you for any loss or damage including whether the loss is foreseeable.

3.6 The content of Outputs is provided for educational and informational purposes only and does not represent our views. It is not intended to be any endorsement and should not be considered as investment advice or a solicitation to buy or sell digital assets. 

3.7 Digital Assets are subject to high market risk and volatility. Before making any investment, you should conduct a comprehensive assessment and seek professional advice from a licensed financial advisor. We disclaim all liability for actions taken or not taken based on the Outputs. 

3.8 To the extent that any Outputs are derived from information provided by third parties, you also agree to the terms and conditions of these third parties. We do not claim any copyright in the materials provided by third parties, or guarantee that they do not infringe other third parties' intellectual property rights. We also do not guarantee the information is accurate, complete or that it is the most up-to-date. BloFin shall not be responsible for the same. 

3.9 BloFin AI provides the Outputs for reference only and does not constitute financial, investment, legal, tax, or other professional advice. Outputs may be incomplete, inaccurate, or outdated and may not reflect your personal objectives, financial situation, or risk tolerance. Trading Digital Assets involves significant risk, including the possible loss of principal. You should independently verify any information and make your own decisions before placing trades or relying on AI-generated content. By using BloFin AI, you acknowledge that you are solely responsible for your decisions and use of the service. BloFin assumes no responsibility for outcomes resulting from AI-generated content.

4. Limitations and restrictions

4.1 Whilst all reasonable endeavors have been made to ensure responses are relevant and free from bias, in exceptional cases, some responses generated may be unreliable or offensive to some users. If you have any concerns, you are strongly encouraged to carefully review these BloFin AI Terms and seek independent professional advice as to whether BloFin AI or the Services is appropriate for you having regard to your personal circumstances and objectives, financial position and risk tolerance level. 

4.2 We try to make sure that BloFin AI is accurate, up-to-date and free from bugs, but we cannot promise that it will be. Furthermore, we cannot promise that BloFin AI will be fit or suitable for any purpose. Any reliance that you may place on the information on the BloFin AI is at your own risk. 

4.3 We may suspend, restrict or terminate access or operation of BloFin AI at any times as we see fit. While we try to make sure that BloFin AI is available for your use, we do not promise that BloFin AI will be available at all times or that your use of the Platform will be uninterrupted. 

4.4 By using BloFin AI, you agree: 

a) that you are solely responsible for all costs and expenses you may incur in relation to your use of BloFin AI;  

b) that you are solely responsible for making any action or making any decisions in relation to your use of BloFin AI;

c) that BloFin AI is a digital tool that combines third-party artificial intelligence with BloFin's product and service range to generate the Output, based on your Input; 

d) not to post, send or share defamatory, offensive, intimidating, illegal, racist, discriminatory, obscene or inappropriate content in any form through BloFin AI; 

e) not to use the Services for any use or purpose that breaches these Terms, BloFin’s Terms of Use, any applicable local, state, or federal laws; 

f) not to use BloFin AI to conduct illegal or immoral activities; 

g) not to use the Services which violates the intellectual property rights of others; 

h) not to misuse or attack BloFin AI by introducing viruses, trojans, worms, logic bombs or any other material which is malicious or technologically harmful (such as by way of a denial-of-service attack);  

i) not to attempt to compromise the security of BloFin AI or access confidential information related to the Services; 

j) not to deliberately attempt to prompt BloFin AI into generating responses which may be offensive and cause harm or reputational damage to BloFin; or  

k) not to copy, distribute, modify, reverse engineer, decompile or attempt to extract the source code of BloFin AI or any components thereof, without our prior written consent. 

4.5 We reserve the right to remove access to BloFin AI in breach of these BloFin AI Terms. 

5. Data privacy and security

5.1 We prioritize the privacy and security of our users' information. Be aware that BloFin AI conversations may be reviewed by our teams to improve results and for training purposes. Do not share in, through BloFin AI, any personal information that is not requested nor required. Do not share your password, private keys, or seed phrases with BloFin AI.

5.2 Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy at [-], which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and regulatory/supervisory authorities in the event you have a query or complaint about the use of your personal information. 

6. Ownership, use and intellectual property rights

6.1 The intellectual property rights in BloFin AI and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from BloFin AI ("Content") are owned by us.

6.2 We reserve all our intellectual property rights (including, but not limited to, all copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit. 

6.3 Nothing in these Terms grants you any legal rights in BloFin AI or the Content other than as necessary for you to access it. Our trademarks and other trademarks and trade names may also be used on BloFin AI or in the Content. Your use of our trademarks (if any) within BloFin AI or in the Content is strictly prohibited unless you have our prior written permission. 

7. Submitting information to BloFin AI

Other than any personal information which will be dealt with in accordance with our Privacy Policy, we do not guarantee that information supplied to us through BloFin AI will be kept confidential and we may use it on an unrestricted and free-of-charge basis as we reasonably see fit.
